The short version. Your order is an offer; it is accepted when we confirm it. Because every pizza is made to order we cannot take it back once the oven is on — but if something is wrong with your food, tell us and we will put it right. Nothing here takes away your legal rights.
Rocce Woodstone Pizza Ltd, trading as Rocce, of 50 Broad Street, Chesham, Buckinghamshire, HP5 3DX. Registered in England and Wales, company number 15268266. Telephone 01494 794 100, email info@rocce.co.uk.
These terms apply to orders placed through this website, through the Eatza ordering system it links to, and by telephone.
Putting items in a basket and paying is an offer to buy, not a completed contract. The contract is formed when we accept that order — when the kitchen confirms it, and you receive a confirmation.
We may decline an order. The usual reasons are that an item has run out, that you are outside the delivery area, that the kitchen is at capacity, or that we cannot make something safely to the allergy instruction given. If we decline after taking payment, we refund it in full.
Our kitchen is not allergen-free and cannot be made so. Wheat flour is in the air, one oven bakes everything, and the same bench is used to prepare every order. Cross-contact is possible with any dish.
Telephone the shop straight away and we will cancel if the food has not started. Once it is being made we cannot, because it cannot be sold to anybody else.
The 14-day right to change your mind under the Consumer Contracts Regulations does not apply to food prepared to order or liable to deteriorate quickly. That is the law, not our policy, and it is the same at every takeaway.
This does not affect your rights if something is wrong. Food that is not as described, not of satisfactory quality, or not fit to eat entitles you to a remedy under the Consumer Rights Act 2015, whatever this section says.
Tell us the same day, on 01494 794 100 or at info@rocce.co.uk. Say what was wrong and what you ordered; a photograph helps. Depending on what happened we will replace the item, refund it, or refund the order.
Refunds go back to the card that paid, and usually take 3 to 5 working days to appear, which is the bank’s timing rather than ours.
We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
We are not liable for loss that is not foreseeable, or for business losses — these terms are for people buying food for themselves.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, for defective products, or for anything else the law does not permit us to limit. Food safety is squarely in that category.
We are not liable for failing to deliver where the cause is outside our reasonable control — a power cut, a flood, a road closure, an oven failure. We will contact you and refund what you paid for anything we cannot deliver.
We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top says when this version came into effect.
These terms are governed by the law of England and Wales, and disputes go to the courts of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings there.
Come to us first — telephone the shop, and if that does not resolve it, put it in writing to info@rocce.co.uk. Complaints about food hygiene can also go to Buckinghamshire Council’s environmental health team.
